Learned advocate for the petitioner submits that he has not been a defaulter yet his vehicle bearing no. NL01AD4308 was taken away. To that effect, petitioner accuses the Officers of Tata Motor Finance Limited. Information was furnished by the petitioner to the police authorities but yet the police authorities did not take any action.

Learned advocate for the State has submitted a report. Report reflects that Itahar Police Station Case No. 365 of 2025 dated 31.05.2025 has been registered for investigation. However, the police authorities have also assessed regarding the

registration number of the vehicle at the toll plaza between 01.04.2025 to 15.05.2025 and till date they are not satisfied whether the said vehicle has passed the Gazole Toll Plaza as also Laxmipur Toll Plaza. Learned advocate appearing for the private respondent no. 4 submits that the petitioner is a defaulter and award has already been passed.

However the finance company till date could not execute the award so passed.

Be that as it may, since the criminal case has already been registered no further order need be passed in the present writ petition.

Accordingly, WPA 11703 of is disposed of.

Report so submitted be kept with the record.

Copy of the report (without annextures) be handed over to the learned advocates appearing for both the parties.
