Learned counsel appearing for the petitioner submits that the District Magistrate and Collector, Hooghly has unintentionally encroached upon and made a construction of concrete passenger shed on the land being RS Plot No.2052 which belongs to the petitioner. Thereafter, the petitioner has made a representation before the District Magistrate, Hooghly being the respondent no.5 to the writ application regarding the issue on 15.01.2024. But till date the said application has not been considered by the respondent no.5. Learned counsel appearing for the State is present. Perused the petition and heard the parties.

As the application dated 15.01.2024 is still pending, this Court direct the respondent no.5 to consider the application at an earliest but not after six weeks from date after giving an opportunity of hearing to the petitioner and allowing him to produce necessary

documents at the time of hearing. The reasoned order to be passed by the District Magistrate shall be communicated to the petitioner at earliest.

The writ petition being WPA 12775 of 2024 is disposed of.

There shall be no order as to costs.
