Sekender Mallick v. The State Of West Bengal And ORS.
D/L 44 23.06.2025 ct.no.35 Kausik W.P.A. 11705 of 2025 Sekender Mallick
Versus
The State of West Bengal & Ors.
Ms. Aparajita Mondal Mr. Biplab Adak ...for the petitioner.
Ms. Jhuma Chakraborty, Sr. Govt. Adv.
Ms. Munmun Tewary ...for the State.
Petitioner is aggrieved by the fact that there was a dispute with the shop for whom the petitioner worked for fabrication of jewelleries. The disputes were relating to wages as the petitioner demanded an increase in the wage. However, the private respondents refused to increase the wages but started threatening the petitioner and the intensity of the threat was such that the petitioner had to flee away from Bangalore to Haripal at his residence. Having considered that the main cause of action arose at Bangalore and the petitioner has informed to Haripal Police Station, I am of the view that in case the petitioner is subjected to any overt action without an order of a Court of Law, in that case, police authorities would ensure that no individual can take the law in his own hands.
However, if there are orders from the jurisdictional courts concerned, police authorities would definitely assist the jurisdictional courts or the police authorities who would adhere to the provisions of law.
With the aforesaid observations WPA 11705 of 2025 is disposed of.
Report so submitted be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
