Petitioner is aggrieved by the fact that earlier in WPA 13996 of 2022 there was a direction from the Co-ordinate Bench pursuant to which the police authorities had been providing security and as such there was no interference with the enjoyment of life and liberty of the petitioner. Subsequently, on 07.05.2025 petitioner complains that the son and daughter-in-law again started pressurizing him for handing over of the property when the petitioner resisted the same, then he was threatened that he would be thrown out of the residence.

Information was furnished to the police authorities. Police authorities on receipt of such

information has drawn up proceedings under section 126/135(3) of the BNSS.

Having considered that the accusations so made are absolutely a family dispute, the police authorities have rightly restricted and restrained themselves. In case, the petitioner is aggrieved, petitioner would approach the appropriate authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The concerned authority if it passes any direction including the direction upon the police authorities, the police authorities would respect, obey and implement such order. In the meantime, police authorities would oversee that no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations WPA 11708 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
