Learned advocate appearing for the petitioner submits that the petitioner was falsely implicated. The de facto complainant is a psychiatric patient.
Learned Advocate appearing for the State draws the attention to the case diary. He submits that the incident took place within six months of the marriage.
In her statement recorded under Section 164 of the Code of Criminal Procedure of the victim, she narrates the incident of torture. The police complaint was lodged within six months of the marriage.
In such circumstances, we are unable to grant anticipatory bail to the petitioner as the petitioner is the husband as is being implicated in offences inter alia under Sections 498A of the Indian Penal Code, 1860. The prayer for anticipatory bail of the petitioner is, thus, rejected.
CRM (A) 2909 of 2022 is dismissed.
