In pursuance of the direction passed by this Court a report is submitted by the Superintendent of Malda District Correctional Home, which is handed over by the learned Advocate for the State during course of hearing.

A photocopy of detention certificate issued by the Superintendent of Malda District Correctional Home, is also tagged with the report which also indicates that this appellant-convict had already served out the sentence as imposed by the learned Trial Court in the impugned judgement and order of conviction and after set off UTP period he was released after serving out sentence on 24.1.2020 from the Malda District Correctional Home.

As the appellant-convict had already served out the sentence the instant appeal becomes infructuous and is liable to be dismissed. 6.

Accordingly, the instant appeal be and the same is hereby dismissed on merit affirming the impugned judgement and order of conviction passed by the learned Trial Court dated 4.6.1999 in connection with Sessions Trial No. 6 of 2001(Sessions Case No. 74 of 2000). 7.

Thus the instant appeal being CRA 243 of 2002 is hereby disposed of. 8.

Let a copy of this order alongwith Trial Court Record be sent down to the learned Trial Court immediately.
