The petitioners allege that the Pradhan, Karanji Gram Panchayat without any reason had deleted the names of the petitioners from the list of Village Folk Women which had been forwarded to the Block Development Officer, Kushmondi Development Block for monitoring the activity and surveillance of water quality as per the guidelines of Jal Jeevan Mission (JJM). It is alleged that the names of Jayanti Deb Sharma (Sarkar) and Rahana Parvin were included by deleting the names of the petitioners. The petitioners are aggrieved by such deletion and it is submitted that the reasons for such deletion were never communicated to them.
It appears that an objection had been filed by Sarjina Khatun, the petitioner no. 1 dated July 30,
2021. Such objection was filed before the Pradhan, Karanji Gram Panchayat. The petitioners are granted liberty to file a detailed complaint before the Block Development Officer, Kushmondi Development Block, with their allegations.
The writ petition is disposed of with a direction upon the Block Development Officer, Kushmondi Development Block to consider and dispose of the complaint of the petitioners, if filed, in accordance with law upon giving a hearing to the petitioners, the Pradhan, Karanji Gram Panchayat and also Jayanti Deb Sharma (Sarkar) and Rahana Parvin.
This court has not gone into the merits of the claims of the petitioners and have not decided the issues raised. All points are left open.
The Block Development Officer will pass a reasoned order and communicate the same to all the parties.
This order shall not be construed as a stay either on the ongoing project or on the process of enlistment of the village folk women.
A copy of the writ petition along with the server copy of this order shall be served upon the Block Development Officer.
Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
