A direction to secure expeditious disposal of Misc. Appeal No. 13 of 2021, pending before the learned Civil Judge (Senior Division), 2nd Court, Baruipur is the ultimate relief sought for in this case. Learned advocate appearing for the petitioner submits that petitioner being defendant has been suffering ad interim order of injunction granted by the Trial Court. An appeal was then carried upon filing Misc. Appeal referred hereinabove against the decision of the Trial Court granting ad interim order of injunction.

The only contention expressed by the petitioner is against the pendency of this appeal, which is submitted to be kept pending.

No other point is raised requiring address by this Court.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite parties.

Service of notice of this application upon

opposite parties stands dispensed with.

Accordingly, the learned Civil Judge (Senior Division), 2nd Court, Baruipur, in Misc. Appeal No. 13 of 2021 is requested to ensure expeditious disposal of pending appeal referred hereinabove, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable.

This would not, however, prevent the court below to take the hearing of this appeal, scheduled to be fixed by the court below on 8th September, 2022. Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

With this observation and direction, the revisional application stands disposed of.
