(DB) 1916 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Debra Police Station Case No. 168 of 2022 dated 08.04.2022 under Sections 363/365 adding Section 376(2)(f)(n) of the Indian Penal Code and Section 6 of the POCSO Act.

And In Re : Khokan Sing ..... petitioner Mr. Siddhartha Sarkar ... for the petitioner Mr. Binay Panda Ms. Puspita Saha ... for the State Petitioner is in custody for 42 days. He prays for bail. Learned Counsel appearing for the petitioner submits that there was a love affair between the parties. Learned Counsel appearing for the State opposes the prayer for bail. He submits that petitioner was a married person and cohabited with a minor.

We have considered the materials on record. Statements show that the petitioner was married and on the false promise of marriage cohabited with the minor.

In view of the aforesaid incriminating materials on record and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
