Learned advocate for the petitioners submits that repeatedly dates have been fixed by the learned magistrate and there has been no progress in the case.

I find that the learned magistrate has taken all endeavour including fixing dates for evidence. However, the orders reflect that both the parties contributed to the delay of the proceeding. The next date as has been informed by the learned advocate is on September/ October, 2023. On and from the said date on each and every month, learned trial court would fix date for the examination of the witnesses. Since the case is of the year 2018, all efforts should be taken so that by 31st January, 2025 trial of the case can be concluded and the verdict can be pronounced.

With the aforesaid observations, CRR 1806 of 2023 is disposed of.

Pending application, if any is consequently disposed of.
