It is indicated by the Stamp Reporter in its report that there is a delay of 493 days in preferring the instant appeal.

The counsel for the appellant submits that the appellant was all along diligent and careful in pursuing the remedy but the circumstances were beyond its control, which occasioned the delay in preferring the appeal.

After perusal of the explanations offered in the instant application, we are satisfied that the appellant was prevented by sufficient cause in not preferring the appeal within the statutory period of limitation. Accordingly, the instant application being CAN 1 of 2024 is hereby allowed.

In Re: MAT 859 of 2024 By consent of the parties, the main appeal is taken up for hearing.

Let this matter be listed on 9th January, 2025 under the heading "For Judgment".
