Mr. Sounak Mukherjee ....for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff in a suit for partition, praying for a direction upon the learned Civil Judge (Sr. Div.), 1st Court at Barasat to dispose of the Title Suit No.260 of 2005 expeditiously. The learned advocate appearing for the petitioner submits that preliminary decree passed on February 19, 2019 and the final decree proceedings in connection with the partition suit is still pending.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite party before the learned trial judge. From the order sheets appended to this application, this Court finds that August 4, 2025 has been fixed for taking steps by the plaintiff.

In the event the plaintiff takes necessary steps regarding paper publication as directed by the orders dated August 31, 2024 and February 19, 2025, the learned Civil Judge (Sr. Div.), 1st Court at Barasat shall proceed in accordance with law and make an endeavour to see that the Title Suit No.260 of 2005 is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties. CO 1866 of 2025 disposed of accordingly.

There will be no order as to costs.
