Learned advocate for the petitioner submits that the petitioner has been accused of alleged recovery of 64.05 kgs. of ganja and he is in custody for more than one year. Charge sheet has been submitted. However, till date witness action has not commenced and only charges have been famed.

Learned advocate for the State opposes the prayer for bail.

Having considered the rigours of section 37 of the NDPS Act is attracted in the present case I am not inclined to release the petitioner on bail. However, petitioner will renew his prayer for bail after evidence of the seizure list witnesses is over. Learned trial court would give priority to evidence of the seizure list witnesses to be examined preferably within a period of three months from the next date fixed.

At this stage, the prayer for bail of the petitioner is rejected.
