The petitioners complain that the private respondents are disturbing peaceful enjoyment of their land. The petitioners cultivated on their land and the crops are ready for harvest. The private respondents are threatening and intimating the petitioners to take away the harvested crop.

Learned counsel for the State has produced a report issued by the Inspector-in-Charge, Gazole Police Station, Malda and the same is taken on record. 3.
It appears from the report that the Gazole Police has made enquiries. The petitioner No.1 has two plots of land and the other four plots owned by other persons. 4.
In the above circumstances, this Court is of the view that the petitioners are entitled to police protection at their own cost. Gazole Police may deploy two constables at the plots of the petitioners to ensure that the petitioners are able to harvest their land peacefully.

The cost of police protection, in terms of Rule 666 of the Police Rules, shall be communicated to the petitioners and deployment shall take effect only after payments.

If the private respondents have any claim on the petitioners' land or dispute the petitioners' right, they may institute appropriate proceedings in accordance with law.

Gazole Police shall strictly comply with any order that may be passed by the Civil Court or statutory authority on them specifically.

The deployment of police picket as directed hereinabove shall be subject to any order that may be passed by the Civil Court or Statutory Authority. 9.
With the aforesaid directions, the writ petition shall stand disposed of.
10.
There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
