The petitioner claims interest on delayed payment of terminal benefits. The petitioner superannuated from service of the WBTCL on 31st October, 2013. He received his terminal benefits of Rs.9,80,201/- towards provident fund on 10.02.2014 and Rs. 5,54,462/- gratuity and leave encashment on 28.08.2014.

The petitioner is entitled to interest for the period from 01.11.2013 to 10.02.2014 at the rate of 6 per cent per annum towards

provident fund and from 01.11.2013 to 28.08.2014 at the rate of 6 per cent per annum towards gratuity and leave encashment. Let the same be paid to the petitioner by the WBTCL within a period of one month from date.

In default of payment as directed above, the rate of interest shall stand increased to 9 per cent per annum.

The writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
