The petitioner alleges that the private respondent has raised unauthorised construction without obtaining sanction from the concerned Panchayat. In an earlier writ petition being WPA 21761 of 2025, an identical allegation was made by the petitioner before this Court. By an order passed on 22nd December, 2025 a coordinate Bench of this Court dismissed the writ petition with an observation that the nature of the construction raised by the private respondent was purely temporary which did not require any prior sanction from the Panchayat. It was also evident that the construction was made in the year 2019. The petitioner could not seek demolition of the structure solely on the ground of absence of a sanctioned plan.

In view of the fact that the issue in the present application has been decided by this Court in an earlier

application, this application is not maintainable and is accordingly dismissed.
