The allegation is that the petitioner raped the 11-year old survivor girl.

We have seen the statement of the survivor girl recorded under Section 164 of the Code of Criminal Procedure. She vividly described the alleged incident. We have also seen the medical report which completely corroborates the victim girl's statement. In view of the aforesaid incriminating evidence, at least prima facie, we are not inclined to allow this application for bail, at this stage.

The application for bail being CRM (DB) 1590 of 2024 is, thus, dismissed.

Since the petitioner is in custody for about four months, we only request the learned trial Court to expedite the trial to the extent the business of the court may permit. Signed By :
