Mr. Sunny Nandy Mr. Tamal Singha Roy ... for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 4th Court. at Alipore to dispose of Title Suit No. 1280 of 2021 expeditiously.

From the order-sheets appended to this civil revisional application this Court finds that a death report of the defendant has been filed. It further appears that by an order dated 30th August, 2024, 19th September, 2024 was fixed for filing particulars of the legal heirs of the deceased defendant no.1 by the defendant no.2 and for further orders. It further appears that 6th May, 2025 has been fixed for filing particulars of the legal heirs of the defendant no.1 by the defendant no.2. Thus it appears that the suit is not ready for hearing. For such reason, this Court is not inclined to pass any direction for expeditious hearing at this stage. With the above observations and directions, C.O. 1860 of 2025 stands disposed of.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
