Mr. Barun Kumar Samanta ...for the Petitioner Mr. Pantu Deb Roy, Mr. Subrata Guha Biswas ...for the State 25-09-2025 AKG Ct. 15 The petitioner applied for an Inter-State Stage Carriage permit for the route from Haldia to Angul before the State Transport Authority, West Bengal.

The prayer was, however, rejected by a resolution dated March 25, 2025, on the ground that there was no vacancy in respect of the said route. However, the report filed by the State before this Court reads as follows: "However, in the light of Notification No. 1890-WT/TPT/1011/26/2020 dated 08.05.2025 issued by the Transport Department, Government of West Bengal, the vacancies created on the route in question due to non-compliance of terms of offer letters by the said Manuda Bibi are to be notified inviting applications from public in general to fill up the same in accordance with the procedures laid down under the motor vehicles act and the West Bengal Motor Vehicles Rules."

In view of the aforesaid, this writ petition is disposed of with a direction upon the State Transport Authority, West Bengal, to take necessary steps for notifying vacancy in accordance with law for the relevant route.

If such vacancy is notified, the petitioner shall be at

liberty to apply for the same, and his application shall be considered in accordance with law along with other applications.

The entire exercise shall be completed within a period of four months from the date of communication of this order.

The resolution dated March 25, 2025, is accordingly set aside.

Accordingly, WPA 11731 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
