Bhattacharya ... for the State Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. There was a fight between family members. Charge-sheet has been submitted.

Learned counsel for the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the FIR which specifically describes the roles played by the present petitioners. He also refers to the statement of the victim and other witnesses which implicate the present petitioners. He also relies on the injury report which shows infliction of serious injury on vital part of the body of the victim like the head.

Considering the above and the other materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
