Mr. Sounak Bhattacharya ...for the petitioner Mrs. Amrita Panja Moulick ...for the State The petitioners are aggrieved by alleged inaction on the part of the Rajabagan Police Station. It is submitted that despite orders of the National Green Tribunal and the learned 3rd Civil Judge (Jr. Division) at Alipore, passed in T.S. No. 228 of 2015, the police have failed to implement any order of injunction against the slaughter of animals in the slaughterhouse being run by the private respondents.

Counsel for the State, on instructions, submits that the slaughterhouse has been closed for a substantial period of time.

This Court directs the Rajabagan Police Station to strictly implement any order passed or that may be passed by the National Green Tribunal, Pollution Control Board and the Civil Court without default and demur. It shall be ensured that the slaughterhouse does not function in the subject property.

The police shall continue to maintain regular vigil in the said area.

Learned counsel for the petitioner, however, submits that slaughter start immediately after the police leave.

In those circumstances, let a police picket be posted outside the said slaughterhouse, for a period of one week from date. In future upon receipt of any complaint in this regard against violation of any order passed by the Civil or Statutory authority, Rajabagan Police Station shall, forthwith, attend to the same and take coercive steps against the persons violating the aforesaid order.

FIR registered by the Rajabagan police shall be investigated within a period of 2 months from date and a final report shall be submitted before the concerned ACJM.

With the aforesaid observations, the instant writ petition shall stand disposed of.

The instructions of the Rajabagan Police Station dated 30.11.2022, addressed to the learned State Advocate, is taken on record.

There shall be no order as to costs.
