-versusSankar Kayal Mr. Sanjib Kumar Mal Ms. Gitashree Mistry ... for the petitioners This application under Article of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Senior Division), Diamond Harbour to dispose of Title Suit No. 97 of 2022 expeditiously.

The learned advocate appearing for the petitioners submits that the suit is for partition amongst three brothers. He submits that the suit has been fixed for exparte hearing on 8th July, 2025. From the order-sheets appended to this civil revisional application it appears that 8th July, 2025 is fixed for ex parte hearing as well as hearing of the petition dated 20th May, 2024.

In view thereof, C.O. 1861 of 2025 is disposed of by requesting the learned Civil Judge (Senior Division), Diamond Harbour to take up the hearing of the application dated 20th May, 2024 on the next date fixed and to make an endeavour to dispose of the same as expeditiously as possible.

After disposal of such application the learned civil judge is requested to make an

endeavour to dispose of the Title Suit No. 97 of 2022 as expeditiously as possible but preferably within a period of six months from the next date fixed for hearing of the said suit.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
