In this regard a photocopy of the letter dated 25th November, 2017 is addressed to Mr. Chandidas Chatterjee, learned advocate on record of the appellant and the same be kept with the record.

In this regard a notice was served upon the learned advocate on record for the respondent on 8th December, including the written instruction of the appellant. The photocopy of the same is kept with the record.

In view of the above submission, the appeal is dismissed for non-prosecution.

The application being CAN 4648 of 2015 is accordingly dismissed.
