Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than one year and till date only four witnesses have been examined out of the 22 witnesses cited in the charge-sheet. Petitioner claims that he has been falsely roped in the present case and was initially arrested in a case of theft, subsequently shown arrested in connection with the present murder case.

Learned advocate for the State opposes the prayer for bail and submits that a forest officer was murdered in the present case. Petitioner who is a Bangladeshi national along with other Bangladeshi nationals attacked forest officials for committing theft of forest products which were resisted by the said officers. Having considered that the petitioner is a foreign national, who according to the prosecution case was present at the time of

alleged commission of offence, at this stage, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 1348 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
