Learned advocate for the petitioner submits that the alleged recovery in the present case is 24.5 kgs of ganja and the petitioner is in custody for more than eight months. 2.

Learned advocate for the State opposes the prayer for bail.

Having considered the period of detention of the petitioner and as the prosecution has relied on seven witnesses in the charge sheet to prove its case I am of the view that the petitioner may be released on bail as some time will be required to take the proceeding to take its logical conclusion. 4.

Accordingly, the petitioner namely Raja Chandra @ Bapi be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned judge, Special Court under NDPS Act, 3rd Court Malda. If on bail, the petitioner shall be physically present on each and every date of hearing before

the jurisdictional court and shall not leave the district of Malda without prior permission of the trial court.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. 6.

With the aforesaid observation, CRM (NDPS) 1202 of 2026 is allowed.
