Das, APP Mr. Utsav Dutta ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody since December, 2024 and till date there has hardly been any progress in the case. Further, the prosecution has relied upon 43 witnesses in order to prove its case and till date only one witness has been examined. Learned advocate for the State opposes the prayer for bail and produces the case diary.

I have taken into account the statement of the witnesses as also the post-mortem report.

Having considered the same, I am of the opinion that, at this stage, it would not be fit and proper to release the petitioner on bail until and unless vulnerable witnesses are over.

Hence, the prayer for bail of the petitioner is Rejected.

Accordingly, CRM (M) 1297 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
