Mr. Saswata Gopal Mukherjee Mrs. Anasuya Sinha ......for the State Mr. Chakraborty, learned counsel appearing for the petitioners is directed to serve a copy of the revisional application to Mrs. Anasuya Sinha, learned advocate who ordinarily appears on behalf of the State. Her appointment should be regularized by the concerned authorities. The revisional application has been preferred challenging the proceedings arising out of Gopalnagar p.S. case No. 172 of 2023 dated 23.03.2023 under Sections 3(r)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 which is pending before the learned 1st Additional District Judge, Barasat.

In view of the incident happening within the premises of the school between the staff/ teachers of the school being Gopalnagar Giribala Balika Vidyalaya, I direct that if the present petitioners namely, Papiya Karmakar and Rinku Mondal appear before the learned Special Court. The learned special Court will allow them to furnish bond for the their bail. The said order would be passed after notice is issued both upon the Public Prosecutor as well as opposite party No. 2.

Court will not insist on physical appearance of the petitioners on the date on which the application is filed for fixing up the date of appearance/surrender of the present petitioner for final disposal of their application for bail which should be affected after service upon the parties. However, the case is at the investigation stage, let the investigation of the case go on and arrive at its logical conclusion when the petitioner would be at liberty to challenge their grievance before this Court.

With the aforesaid observations, CRR 1814 of 2023 is disposed of.

Pending applications, if any, is consequently disposed of.
