Petitioner is aggrieved by the fact that the order dated 14.05.2025 in T.S.692 of 2025 wherein the learned Civil Judge (Junior Division), 6th Court, Howrah was pleased to direct to maintain status quo in respect of nature and character of the suit property referred to in the plaint. Petitioner claims that in spite of such an order being passed by the civil court, the same is violated at the behest of the private respondents.

State has submitted a report wherein it reflects that during enquiry the police authorities have found that the private respondents and local people are constructing a foundation for the structure of mazar.

Petitioner would approach the civil court for rendering police assistance and in case a direction is passed for implementing the order dated 14.05.2025, the police authorities would respect, obey and implement the order. In the meantime, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting arising out of the construction which is taking place referred to in the police report. With the aforesaid observations, WPA 11627 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
