In view of the report submitted by the learned Additional Chief Judicial Magistrate, Raghunathpur, Purulia dated 11.09.2023 through the District Judge, Purulia stated that the Misc. case No. 34 of 2005 has been disposed of on 28.04.2011. The report filed by the Inspector-in-Charge, Raghunathpur Police Station dated 17.08.2023 stated that the opposite party No. 2 has expired about eight to nine years ago. Let the said report be kept on record.

The learned advocate for the petitioner submits a written instruction that his client does not wish to proceed with the matter. A written instruction dated 05.09.2023 submitted before the court to that effect be kept on record.

Under the facts and circumstances, the instant criminal revesional application being CRR 1937 of 2011 is dismissed for non prosecution.
