Learned advocate appearing for the petitioner submits that the petitioner is in custody for 9 months and till date, only charges have been framed, but witness action has not commenced.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the victim is three and a half years old and the present petitioner is 33 years old.

There are materials in the case diary to support the prosecution case. Having considered that the evidence of the victim is not yet over, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

Petitioner would be at liberty to approach this Court after the evidence of the parents of the victim, victim and another child who has been made a witness in this case is examined by the learned Trial Court.

Learned Trial Court would put in efforts so that within a period of five months from the date of communication of this order evidence of all the witnesses is over. The application for bail, being CRM (M) 1304 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
