Rakib (Allowed) CRM (M) 1302 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Dakshineswar Police Station case no. 11 of 2023 dated 13.01.2023 under Sections 186/333/353/326/307/34 of the Indian Penal Code and under Sections 25/27 of the Arms Act.

Learned advocate appearing for the petitioner submits that earlier there was a direction of this Court on 14.11.2025 in CRM (M) 1944 of 2025 to complete the evidence of 10 more witnesses at a stretch of four months. It has been submitted that the evidence of 10 more witnesses have been completed. Another 7/8 witnesses are left to be examined by the prosecution, as such petitioner may be released on bail.

Mr. Das, learned Additional Public Prosecutor opposes the prayer for bail.

I have taken into account the period of custody of the present petitioner and without entering into the merits of the case, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Md. Sanu @ Sonu @ Nashim Akhtar shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only), one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court and shall not leave the jurisdiction of district of North 24 Parganas without the prior permission of the learned trial Court.

Additionally, if on bail, the petitioner would for the next six months once in a fortnight meet with the Officer who is assigned for acknowledging the presence of the petitioner by the Inspector-inCharge/Officer-in-Charge of Dakshineswar Police Station. With the aforesaid observation CRM (M) 1302 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
