Mr. Apurba Kumar Datta, learned advocate appearing on behalf of the petitioner and Mr. Soumyadeep Biswas, learned advocate appearing on behalf of the opposite jointly submit that although by the present application under Section 24 of the Code of Civil Procedure the petitioner has prayed for transfer of matrimonial suit being Matrimonial Suit No. 192 of 2015 pending before the 2nd Court of learned District Judge, Katwa, Purba Burdwan under Section 9 of the Hindu Marriage Act, 1955 but during the pendency of the present application the parties have applied for divorce by mutual consent. In view of such development the application has become infructuous.

C.O 1872 of 2016 is dismissed as infructuous. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
