The writ petitioner's complaint is that a representation made on 16th June, 2022 to the State Bank of India has not been considered till date. Learned counsel appearing for the Bank submits that this representation has not been received by the Bank. It is also submitted that this is the third writ petition filed by the petitioner in terms of the same loan and the prayer for one time settlement in respect of the same.
After considering the submissions and the fact that the earlier litigations filed by the petitioner, which are claimed to be pending till date, are not on record. This court is of the view that the respondents may be given an opportunity to bring on record such
documents at the time of considering the representation of the petitioner. The petitioner also shall have the liberty to rely upon all orders passed by the co-ordinate Bench of this court in the subject matter.
W.P.A.11098 of 2022 is accordingly disposed of with a direction on respondent no.4 being the Authorised Officer, State Bank of India to consider the representation of the petitioner dated 16th June, 2022 and dispose of the same by passing a reasoned order within a period of three weeks from today. The reasoned order shall be passed upon hearing the stand taken by the petitioner and under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. A copy of the reasoned order shall be given to the petitioner within a week such order is passed. Parties shall be at liberty of taking appropriate steps after disposal of the representation of the petitioner as directed above.
