Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. There were pending civil disputes between the alleged victim and the petitioners. On mere suspicion, the petitioner has been named as accused in this case.

Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the FIR, the post mortem report and the statements of witnesses, including the ones made before the learned Magistrate. There are several witnesses who had seen the present petitioner along with three or four persons standing at the same place in the evening from where the dead body of the victim was found soon thereafter. There is also a diary of the victim obtained from his house. There are CDR and tower location details which confirm that the petitioner was there at the time of occurrence.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
