As none appears on behalf of the State, Ms. Manisha Sharma, learned advocate, is directed to appear and represent on behalf of the State in this matter. Her appointment may be regularised by the concerned authorities.
The revisional application was preferred challenging the proceedings relating to Jorasanko Police Station Case No.26 of 2011 dated 31.01.2011 under Section 420/120B of the Indian Penal Code then pending before the learned Additional Chief Metropolitan Magistrate, Calcutta.
The records of the present revisional application reflect that the revisional application appeared once on 7th May, 2012 before a co-ordinate Bench of this Court and the said Bench was pleased to direct to serve upon the other side. As there was no interim order or no information has been furnished regarding the present stage of the proceedings before this Court and the petitioner approached this Court at a stage when the
investigation was under progress, I am of the view that no interference is called for as the grounds which have been canvassed in the revisional application are questions of fact. Accordingly, CRR 1725 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
