Learned advocate appearing for the petitioner submits that the petitioner is in custody for one year and ten witnesses have been examined out of the 28 witnesses cited by the prosecution. It has also been contended that the evidence which till date has surfaced do not implicate the present petitioner, as such the petitioner may be released on bail on stringent conditions.

On the other hand learned advocate for the State submits that the offending weapon was recovered at the behest of the present petitioner. There was a land dispute between the petitioner and the accused and the attending circumstances do point allegedly towards the guilt of the present petitioner as is revealed from the materials appearing in the Case Diary.

Having considered the stage of the case, I am not inclined to release the petitioner on bail.

Learned trial Court has expedited the trial, let steps be taken so that substantial progress takes in the next six months. Petitioner would be at liberty to approach this Court after the said period is over.

At this stage, CRM (M) 1349 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
