Pursuant to the direction passed by this Court on 13th August, 2021, the University has refunded to the father of the petitioner the amount of Rs.65,750/- only through NEFT on 18th August, 2021.

The learned advocate appearing for the petitioner prays for costs to be paid by the College on account of the harassment faced by the petitioner in approaching the Court as the College did not follow the UGC guidelines.

Be it mentioned that the petitioner was compelled to withdraw his candidature from the BA LLB Honours course in the Amity University on account of financial crisis caused due to Covid-19 pandemic.

Admittedly, UGC published a guideline pursuant to which the refund of the amount has been made to the petitioner. The Secretary, UGC by communication dated 17th December, 2020 intimated the ViceChancellors of all Universities to ensure compliance of the UGC guidelines in respect of refund of fees. There was no need for the petitioner to approach the Court had the College taken steps for refund of the amount to the petitioner in accordance with the UGC guidelines.

In view of the above, the College is directed to pay cost of Rs.5,000/- (Rupees Five thousand only) to the petitioner within a week from date.

The Payment Advice handed over by the learned advocate representing the respondent Nos. 1 and 2 is retained with the records.

WPA 12468 of 2021 stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
