Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of the direction passed by the learned Civil Judge (Junior Division), Kalna upon the Officer-in-Charge, Kalna Police Station, initially they were reluctant for taking measures. However, subsequently a report has been submitted before the jurisdictional Civil Court in seisin of T.S. 144 of 2023.

Learned advocate for the petitioner submits that presently there is no grievance. However, if situation so arise, petitioner may be granted liberty to approach this Court.

Learned advocate appearing for the private respondent submits that since a private dispute has

been referred to in the writ petition there is hardly any scope for interference by this Court.

State has already submitted a report. Since no grievance is expressed by the petitioner at this stage, I am not inclined to pass any directions. However, if the petitioner or the respondent is faced with inconveniences and since the civil court is already in seisin of the issue, both the parties would be at liberty to approach the civil court with their respective prayers.

With the aforesaid observations WPA 11864 of 2025 is disposed of.

Report so submitted be kept with the record.
