Mr. Ranjan Kali Ms. Payel Nath ..for the petitioner Mr. Debanjan Mukherjee ..for WBSEDCL The petitioner applied for an electricity connection to establish a dairy milk and pisciculture project. However, West Bengal State Electricity Distribution Company Limited (WBSEDCL) declined to provide the connection on the ground that it was not considered to be techno-commercially feasible.

Learned counsel appearing on behalf of the petitioner submits that WBSEDCL had initially issued a quotation for ₹27,986/-, which was duly deposited by the petitioner. Subsequently, WBSEDCL rejected the petitioner's request for the electricity connection. The learned counsel further submits that the petitioner is now willing to apply afresh for an electricity connection with a load requirement of 15 K.V. In this context, the petitioner seeks a refund of the security deposit previously made.

In view of the above, there is no necessity to keep this writ petition pending.

Accordingly, this writ petition is disposed of, granting liberty to the petitioner to apply afresh for an electricity connection.

If such a fresh application is made, the same shall be considered by WBSEDCL in accordance with law. Given that the amount was deposited by the petitioner pursuant to the quotation issued by WBSEDCL as early as in 2017, and that such amount continues to be held by WBSEDCL, it is hereby directed that the said amount be refunded to the petitioner along with interest at the rate of 7% per annum, calculated from the date of deposit until the date of repayment.

Accordingly, WPA 13021 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
