The petitioner seeks anticipatory bail.

Learned Advocate for the petitioner submits that the petitioner was falsely implicated.

Learned Advocate for the State draws the Court's attention to the contents in the case diary.

Considering the nature of the offence and considering the involvement of the petitioner and the material in the case diary, we are inclined to grant anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and shall abide by the conditions as laid down under Section 438(2)

of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall cooperate in the investigation. In case the petitioner fail to adhere to any of the conditions mentioned in Section 438(2) of the Code, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court.
