11.08.2021 Item No. 5 Ct. No. 04 PG S.A.T. 2503 of 2001 (Via Video Conference) r Sri Narayan Chandra Pal Vs.

Sri Bimal Jar & Ors.

None appears on behalf of appellant. Same situation prevailed on 8th July, 2021, when following order was made:

"The second appeal tender is of year 2001. Errors of mention of dates of the decrees furnished in the memo have been reported. None appears on behalf of appellant.

Let notice be issued to the learned advocate enclosing copy of this order. In event appellant continues to go unrepresented on adjourned date or thereafter, the appeal is likely to be dismissed.

List in monthly list of August, 2021."

Noting dated 30th July, 2021 says the notice was returned unserved with endorsement "Not found". Since the defect can be removed after the appeal has been moved for admission and printed list having had been published, we are convinced appellant has lost interest.

S.A.T. 2503 of 2001 is dismissed.
