submits that the petitioner has been deceived and as such approached the jurisdictional Police Station. Learned advocate for the State submits that the information was furnished with the police authorities for recovery of the amount. There are trapping of contractual obligations for which the police authorities did not find any culpability having been made out and as such did not register any case.

In view of the stand taken by the State and the version of the petitioner, I am of the view that the doors of the petitioner as such cannot be closed.

Petitioner would be at liberty to approach the jurisdictional Court under Section 175(3) of the BNSS when the learned Magistrate will assess and ascertain regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 12242 of 2025 is disposed of.

Report submitted by the learned advocate appearing for the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
