Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case relate to alleged recovery of 30.09 kgs of ganja. Petitioner is in custody for 169 days and although, charge-sheet has been submitted but till date charges have not been framed. Prosecution has relied upon 17 witnesses in support of its case.

Learned advocate for the State opposes the prayer for bail. I have taken into account the quantum of seizure and the fact that charge-sheet has been submitted, at this stage, I am not inclined to consider the prayer for bail of the petitioner in view of the rigors of Section 37 of the NDPS Act is attracted. Petitioner will renew his prayer for bail after the evidence of seizure list witnesses are over.

To that effect, learned trial Court will expedite the process and ensure that within three months from the date consideration of charges the evidence of seizure list witnesses are completed. With the aforesaid observations, CRM (NDPS) 1206 of 2026 is rejected at this stage.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
