Mandal ...for the State Mr. Jayanta Samanta ...for the Private Respondents It is the grievance of the petitioner that respondent nos. 9 to 11, without obtaining any permission from the concerned Gram Panchayat, have undertaken construction work on a plot of land owned by him.

Learned advocate appearing for the petitioner has drawn the attention of this Court to page 23 of the writ petition to contend that, despite a representation having been made, the Prodhan of Lochanpur Gram Panchayat has failed to take any action in the matter.

Attention of this Court has also been drawn to a communication dated April 8, 2025, furnished to the petitioner under the provisions of the Right to Information Act, 2005, to demonstrate that no sanctioned plan exists in favour of respondent nos. 9 to 11 in respect of the said construction.

Respondent nos. 9 to 11 are represented.

Having regard to the aforesaid facts, this Court does not find any justification to keep the present writ petition pending.

Accordingly, the writ petition is disposed of with a direction upon the Lochanpur Gram Panchayat to take necessary steps in terms of Section 23(5) of the West Bengal Panchayat Act, 1973, if it is found that the construction undertaken by respondent nos. 9 to 11 has been made without any sanctioned plan.

Let such exercise be completed within a period of three months from date.

WPA 11925 of 2025 stands disposed of accordingly. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
