Petitioners are aggrieved by the fact that the 18.02.2025 Court No. 35 Item No.41 Rakib private respondents are forcefully occupying the shop room which is a trust property and the private respondent nos. 5 and 6 are forcefully occupying the same without having any authority of law. It is further alleged that the devotees and/or the trustees are facing resistance at times and to that extent when informed to the administrative authorities they are not getting any support both for the devotees as well as for the trustees in respect of their religious activities.

Learned advocate for the State has submitted that the private respondents are in possession. So far as the police authorities are concerned they are not in position to handle a civil dispute between two individuals or groups. However, police authorities have earlier taken steps in case any emergent situation which arose. I have considered the submissions of the State as well as that of the petitioners, I am of the view that at this stage this Court would restrict its directions to the extent that the police authorities would keep a surveillance and

oversee that there is no breach of the peace and/or tranquility or no disturbance or untoward incident resulting from the strained relationship existing between the petitioners and the private respondents or at the behest of the private respondents.

With the aforesaid observations WPA 12873 of 2024 is disposed of.
