Mr. Sounak Bhattacharya, Mr. Sounak Mondal ...for the petitioners Mr. Biswajit Sau ...for the State The grievance of the petitioner is directed against the failure of the concerned respondent authorities, being the respondent no. 8.

It is submitted on behalf of the petitioner that despite having filed complaints regarding the alleged illegal and unlawful construction, the respondent no. 8 has failed and neglected to take any steps. There has been no consideration of the representation dated January 02, 2024 filed by the petitioner with the respondent no. 8.

The State respondents are represented and have filed a police report, which suggests that there is illegal and unlawful construction.

In view of the above, the respondent no. 8, being the Pradhan, is directed to consider the representation of the petitioner within a period of eight weeks from the date of communication of this

order and, if necessary, after giving a right of hearing to all the affected parties.

It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided by the Pradhan in accordance with law.

With the above directions, W.P.A. No. 12879 of 2024 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
