Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years 8 months and till date out of 14 witnesses cited by the prosecution only 8 witnesses have been examined. There is no possibility of the trial being taken to its logical conclusion at an early date, as such, the petitioner may be released on bail.

On the other hand, learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 164 of Cr.P.C. as also medical report.

Although both the documents are not very encouraging

but having regard to the period of time which has lapsed and some more time will be required to take the trial to its logical conclusion, I am of the view that the petitioner may be released on bail. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Hasan Laskar @ Kalo shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, Alipore, 24 Parganas (South). If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the jurisdiction of the district of 24 Parganas (South) without prior permission of the learned trial court. Additionally, petitioner shall not enter the jurisdiction of Jibantala Police Station without prior permission of the Inspector-in-Charge/Officer-inCharge or the jurisdictional court in seisin of the case. With the aforesaid observations, CRM(M)1311 of 2026 is allowed.
