Heard learned Counsel for the petitioner and learned Counsel for the State, who has placed the case diary. 2.

It appears that the victim and the accused are husband and wife and have been married for 25 years. A general allegation as to regular torture both physical and mental has been alleged and during an altercation the victim/complainant has received an injury which resulted in stitches.

Considering that the parties are in a conjugal relationship and this is apparently a sole incident which has occurred, the petitioner is granted anticipatory bail.

Accordingly, in the event of arrest, the petitioner, namely Mirajul Islam @ Mirazul Islam @ Pintu shall be released on bail upon furnishing a bond of Rs.5,000/-, with two registered sureties of like amount each to the satisfaction of the arresting officer and

shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that the petitioner shall report to the Investigating Officer of the concerned Police Station once in a week until further orders.

In case the petitioner fails to adhere to any of the conditions mentioned hereinabove or in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 6.

The application for anticipatory bail being CRM (A) 1771 of 2025 is disposed of.
