Learned counsel for the petitioner submits that the petitioner is in custody for about 100 days. Co-accused have been granted anticipatory bail. Further custody of the petitioner is not required. He prays for bail. Learned counsel for the State opposes the prayer for bail.

I have considered the material on record. The petitioner appears to be one of the principal assailants. The offending weapons have been recovered pursuant to the leading statement of the petitioner. He does not appear to be similarly circumstanced with the co-accused who are on anticipatory bail. He has also been named in the statements under Section 164 of the Code of Criminal Procedure.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, the prayer for bail of the petitioner is rejected at this stage.

The application for bail is disposed of.
