The petitioner has challenged the notice dated May 20, 2026 issued by the Block Land & Land Reforms Officer, Uttar Dinajpur under Section 4C(5) of the West Bengal Land Reforms Act, 1955.

When it was pointed out to Mr. Chaudhuri, learned advocate that the remedy of the petitioner lies before the West Bengal Land Reforms and Tenancy Tribunal in view of the provisions laid down under Sections 6, 7 and 8 of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997 as the challenge thrown in this writ petition is against a notice issued under the provisions of the West Bengal Land Reforms Act, 1955, which is a specified Act under Section 2(r) of the 1997 Act, Mr. Chaudhuri, learned advocate submits that the instant writ petition was filed before the Vacation Bench when the Tribunal was also not

functional. He prays for leave to withdraw this writ petition with liberty to approach the appropriate forum in accordance with law.

Mr. Chaudhuri further submits that it may take some time for the petitioner to file an appropriate application before the Tribunal and move the said application, Mr. Chaudhuri, therefore, prays for extension of the interim order for a limited period.

The learned advocate appearing for the State, however, opposes the prayer for extension of interim order. Considering the fact that the petitioner approached this Court at a point of time when the Tribunal was not functional and the petitioner is enjoying an interim order, this Court is inclined to extend the interim order for a limited period.

The interim order passed on May 29, 2026 is extended till the end of the month of September, 2026 or until the matter is taken up by the Tribunal, whichever is earlier.

Accordingly, the writ petition stands dismissed as withdrawn with liberty to the petitioner to approach the Tribunal on the self same cause of action.

There will be no order as to costs.
